WARRANTY Rambusch custom fixtures carry a warranty of two (2) years on construction and materials. Incorporated ancillary equipment (specifically, Xicato LED illuminators and third party drivers) carries a standard warranty of five (5) years.
Rambusch provides warranty service within the scope of the work and materials that it provides. This includes on-site support for castings, painted surfaces and finishes, and integral electrical components that are necessary to operate incorporated ancillary equipment from other manufacturers (see above). This warranty expressly does not cover issues arising from field connections made by electricians or other installation personnel. Rambusch shall not be responsible for normal weathering, wear and tear, breakage or acts of vandalism.
Rambusch warrants that the products manufactured by it shall be free from defects in material and workmanship for a period of two (2) years from the date of shipment. On components furnished by Rambusch but manufactured by others (see above), a written warranty of the manufacturer, if any, will be assigned to buyer; however, Rambusch does not adopt and does not warrant or represent any such component parts or the enforceability of such third party warranties. Rambusch’s sole obligation under this warranty shall be, at its option, to repair or replace its defective product. There are no other expressed warranties including any warranty of merchantability or fitness for purpose. Rambusch shall not be liable for consequential damages or cost of removal or reinstallation of its products. This warranty shall not apply to defects or damage caused by shipping, improper installation, improper use or abuse of the product.
CONSEQUENTIAL DAMAGE SELLER SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, CONTINGENT OR INCIDENTAL DAMAGES WHATSOEVER. Rambusch is not liable for damages of any kind resulting from any delay or failure to deliver or perform due to strikes, lockouts or other labor difficulties, transportation difficulties, accidents, fires, acts of God, or any other causes of like or unlike the nature beyond Rambusch’s control.
INDEMNITY Customer shall hold harmless and indemnify Rambusch and its directors, officers, servants, agents, subsidiaries, employees and assignees, or any of them, from and against liability, loss or damage arising out of claims that Customer’s contractors and subcontractors, or any person on whose behalf Customer enters into this agreement, may have for property damage sustained by them and for bodily injury or property damage sustained by their employees, resulting from purchase of this equipment.
TERMS AND CONDITIONS OF SALE No quotation, order acknowledgement, and no provisions of these terms and conditions of sale shall be changed in any respect except as specifically agreed to in writing and signed by an officer of Rambusch. No statement, representation or warranty not contained herein shall be binding on Rambusch unless made in writing and signed by a duly authorized officer of Rambusch.
RISK OF LOSS The risk of loss shall pass to the buyer upon delivery by Rambusch to the carrier at Rambusch’s plant in Jersey City, New Jersey. All claims for damage or loss in transit must be made by buyer directly to common carriers. Damage in transit or disputes with carriers regarding damaged product does not relieve buyer’s obligation to timely pay the full amount of Rambusch’s invoice.
AUXILIARY EQUIPMENT (Ballasts, transformers and lamps) furnished as components with our products carry the warranties of the manufacturer of that equipment (see above). Rambusch’s guarantee does not extend to such components. Defective ballasts or transformers under warranty are to be delivered by the user to the manufacturer’s designated service distributor for replacement in accordance with their standard terms.
